Scenario:

A lady on holiday in Spain went to the beach for the afternoon to soak up some sun, during the day she decided that she would like to take a dip in the sea, but did not want her watch and jewellery on as they would get wet.

She decided to discreetly wrap them up in a tissue and bury them in the sand under her towel so that they in her mind were safe.

After a pleasant afternoon she picked up her belongings and walked off the beach, upon getting to the road she realised that she had not retrieved the tissue she buried with the watch and jewellery inside.

Turning to look back at the beach she had no idea how to locate exactly where she had been sitting and thus was unable to locate the items she had buried earlier in the day.

After submitting the claim, the policyholder was very upset to learn that her claim was declined because the policy conditions required her to exercise reasonable care for the safety and supervision of her property. She initially could not understand that leaving the items buried and unattended whilst she was in the sea, could not be deemed as reasonable care.

Naturally we approach all claims in a fair and sympathetic manner, however our remit is dictated by the policy terms and conditions under which the claim is being made. In this instance it would have been against the insurance policy terms and conditions to have paid out her claim.
